It is important to know what the term “trade fixtures” entails when entering into a commercial lease. Trade fixtures are often defined as dental equipment, dental chairs and dental lighting (whether or not affixed to the walls or floor) installed and purchased by the Tenant for its individual use. Trade fixtures typically remain the property of the Tenant and understanding what a Tenant is required vs permitted to remove when a lease ends is an important consideration when entering into a new Lease. If the trade fixtures are old, or the cost to remove them and restore the leased premises after removal is too high, a Tenant may not want to be required to remove them when the lease ends. Other times, a Tenant will want to remove its trade fixtures, or some of them, in order to reuse them at a different location.
